SMARTWAY INC., a Delaware corporation doing business in California as SMARTWAY AI INC. ("Smartway," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit our website at smartway.ai (the "Site") or use our software-as-a-service products, including Smartdetection and Smartdecision (the "Services").

Usage and Device Information:

  • IP address, browser type, operating system, device identifiers
  • Pages visited, links clicked, features used, time spent on the Site or Services

Customer Data: If you are a business customer, you control the retention and deletion of Customer Data submitted to the Services. Upon termination of your account, we will make Customer Data available for download for thirty (30) days, after which we may delete it unless legally required to retain it.

Access and Portability:

You may request a copy of the personal information we hold about you.

Correction:

You may request that we correct inaccurate or incomplete personal information.

Deletion:

You may request that we delete your personal information, subject to certain exceptions (e.g., legal obligations, legitimate business purposes).

Opt-Out of Marketing:

You may opt out of receiving marketing communications by following the unsubscribe instructions in our emails or contacting us directly.

Do Not Sell My Personal Information:

Smartway does not sell personal information as defined under California law (see Section 7).

6. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

If we collect sensitive personal information (as defined under CPRA), you have the right to limit its use to purposes permitted by law.

Authorized Agent:

You may designate an authorized agent to submit requests on your behalf. We may require proof of authorization.

We will verify your identity before processing your request and respond within 45 days (extendable by an additional 45 days if needed).

7. Do Not Sell My Personal Information

Smartway does not sell personal information as defined under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). We do not exchange personal information for monetary or other valuable consideration.

We may share personal information with third-party service providers for business purposes, as described in Section 3 (How We Share Your Information), but these disclosures are not considered "sales" under California law.

8. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to collect information about your interactions with our Site and Services. Cookies are small text files stored on your device that help us provide, secure, and improve our Services.

When you use our Services as an authorized user on behalf of your organization (our business customer), we act as a service provider (under CCPA) or processor (under GDPR) of personal information contained in Customer Data.

Our Role:

  • We process Customer Data solely on behalf of our business customer and according to their instructions.
  • Our business customer (your organization) is the business (under CCPA) or controller (under GDPR) and determines the purposes and means of processing.
  • We do not use Customer Data for our own purposes beyond providing the Services.

Your Rights:

If you are an authorized user, please direct any privacy requests regarding Customer Data to your organization, as they control such data.

Data Processing Agreement:

Our business customers enter into a Data Processing Agreement (DPA) that governs our processing of Customer Data, available on smartway.ai.

10. Security

We implement reasonable administrative, technical, and physical safeguards to protect personal information from unauthorized access, use, disclosure, alteration, or destruction. These measures include:

  • Encryption of data in transit and at rest
  • Access controls and authentication mechanisms
  • Regular security assessments and monitoring
  • Employee training on data protection practices

However, no security system is impenetrable. We cannot guarantee the absolute security of personal information. If you believe your account has been compromised, please contact us immediately.

11. International Data Transfers

Smartway is based in the United States. If you access our Services from outside the United States, your personal information may be transferred to, stored, and processed in the United States or other countries where our service providers operate.

These countries may have data protection laws that differ from those in your jurisdiction. By using our Services, you consent to the transfer of your personal information to the United States and other countries.

If you are in the European Economic Area (EEA) or United Kingdom, we rely on Standard Contractual Clauses (SCCs) or other lawful transfer mechanisms approved by the European Commission or UK authorities to transfer personal information to countries outside the EEA/UK.
